市场法治不是天然有效的 ,它需要相应“制度伦理”的支持和引导 ;制度伦理有规约政府成员、经济人、平民三层次法治和经济含义 ;制度伦理的生成应是中国特色社会主义市场经济乃至市场法治“内生”的结果 ,应是世界市场法治伦理精神与中国传统法治道德文明的结合 ,是道德功效价值和人文价值的统一 ,是制度伦理文本形态与实践形态的交融。

Rule of law of the market is not naturally effective,it accordingly needs the support and guidance of the ethics of the regulation.Ethics of the regulation restrains the members of the government,the brokers and the populace,with a three level meaning about rule of law and economy.Its formation should be the result of the socialist market oriented economy with Chinese characteristics,and even the inherent result of rule of law of the market.It should be the combination of the spirit of rule of law and ethics in world market with the moral civilization of the Chinese traditional rule of law.It should be the unity of the moral effective value and the humanist value.It should be the blending of its text form and practice form.
