论档案法制环境

On the Environment of Legal System of Archives

如果把档案法制视为一个系统，则与这个系统中互为关系的档案立法、档案执法、档案法规监督等系统要件发生直接或间接联系的一切要素与条件，均被视为档案法制环境。而系统功能的发挥不仅取决于系统内部结构的规范与科学，而且还受制于这个系统工作的外部环境。文章论述了档案法制系统外部环境的主要构成因素、存在问题，针对性地提出改善对策，以逐渐解决档案法制环境中的“困区”、“盲区”、“空区”、“闭区”现象。

Abstract If we look upon the legal system of archives as a system, archival legislation, their enforcement and supervision in it are interrelated. All the elements and conditions directly or indirectly related to them are regarded as the environment of legal system of archives. Developing the systematic function of archives not only depends on the unification and science of inside structure of the system, but also is controlled by outside environment of the system. The article discusses the main forming factors and existing problems of the outside environment of the legal system of archives, at the same time puts forward improving measures in order to remove gradually the phenomena of ″difficult area″, ″ blind area″, ″empty area″ and ″closed area″.
