规范的分析是部门法理学研究的重要内容。本文运用经济学的成本收益分析方法,剖析了专利制度授予发明创造有限垄断地位后,社会与私人的成本和收益及其冲突,阐释了专利制度平衡私人收益与社会收益的经济合理性,并提出了完善有关规范的建议。

This paper analyses the social interest and the private interest based on the patent institution through economic costs and revenus analysis. Then the author expounds the rationality of the patent institution keeping balance between the social revenus and the private revenus, and puts forward the proposals which will help to prefect the norms.
