Appraisal and Perfection of Current Matrimonial Property Regimes

我国现行的夫妻财产制是由2001 年新婚姻法确立的,是法定财产制与约定财产制相结合,在法定财产制中共同财产制与个人特有财产制相结合的夫妻财产制。这种制度适应了生产力的 发展,有相当进步,但也存在一些缺失。本文对现行夫妻财产制进行了评价并对其完善提出了建议。

The current matrimonial property regimes of our country has been established in the 2001 Marriage Law, which combines the legal property regimes and the agreeable property regimes. And in the legal property regimes, the common property regimes have combined with the personal property regimes. This kind of regimes meets the development of productivity, with quite progress but also some loses. This article aims to appraise the current matrimonial property regimes and give some suggestions to perfect it.
