The Obligation of Disclosure of the Assured in Marine In surance

导言任何合同的签订,都应以合同当事人的诚信为基础。现代各国基本上都从法律上确认了诚信原则,并且把它视为民商法的一项基本原则,我国《民法通则》第四条规定:“民事活动应当遵循……诚实信用的原则”。《经济合同法》亦规定,采取欺诈,胁迫等手段所签订的合同为无效经济合同,从订立的时候起。

The principle of Utmost Good Faith is a special Pprinciple in a marine insurance contract.The author argues that,apart from General Good Faith,the assured should hold specified obligation of disclosure.On the basis of legal enactments and British Case Law, the article expounds the substance and deadline for performance of the obligtion for disclosing,the essentials and result of the assured's breach of the obligation.In the end the author put forward his point of view about the general marine insurance practice in China.
