从农地产权变革看“小产权房”的合法化问题——以成都土地制度改革为视角

摘要 产权理论有关产权性质的讨论有两点对于土地权利问题的认识是具有解释力的,即产权需要得到正式制度的界定和保障,反过来产权权能自发的拓展和转化引起的行为方式的改变又会推进正式制度的不同层次的变化。成都土地制度改革在遵循产权规律的指导下取得了阶段性的成果,许多有益的实践经验对于解决不同形态的围绕农村集体土地产生的问题具有启发意义。"小产权房"这一社会难题亦可在探索农地产权改革的可行途径中得到解决。 Discuss the property right theory of property rights has two points for land rights is the explanation, namely property rights need to be defined and security of formal system, which in turn property right spontaneous expansion and transformation induced by the changes of behavior and will promote the formal institutions of different levels of change. Chengdu land system reform has achieved initial results in the following property under the guidance of the laws, many beneficial experiences has enlightening significance on the rural collective land produced to solve the problem of different forms."The small property right house"as social problem is solved in a feasible way to explore the reform of land property.
