检察机关适用指定居所监视居住问题探讨

A probe into the procuratorate's watch on the designated residence

修改后刑诉法首次对指定居所监视居住作出规定。由于法条制定上的不完善,其具现实重大意义的背后也带来了新的适用问题和争议。最高检新出台的《人民检察院刑事诉讼规则(试行)》对指定居所监视居住的相关程序作出了进一步明确,但仍不够细化,因此有必要通过明确监视执行期限、完善权利救济机制、进一步细化界定标准、明示执行场所范围来进一步解决指定居所监视居住的适用问题。

The modified criminal procedural law stipulates the procuratorate's watch on the designated residence. Owing to its imperfection of stipulations,it brings about new problem of application in spite of its great significance. The Criminal Procedural Rules of People's Procuratorate issued by the Supreme People's Procuratorate further defines the relative procedure of watch on the designated residence,but it remains to be specified in detail. Therefore,it is necessary to solve the problem of application of watch on the designated residence by stipulating the execution period of watch,perfecting the right aid mechanism,stipulating the definition standard and specifying the execution scope.
