马克思法哲学价值论真谛辨析——兼与公丕祥先生商榷

On Essence of Axiology of Marx's Legal Philosophy:a Discussion with Mr. Gong Pi-xiang

公丕祥先生提出:马克思从个人与社会、法的现象与自由、平等与权利之间的关系等方面,精辟地阐发了法的现象的价值属性,实现了文明社会法哲学价值论领域的伟大变革是马克思法哲学价值论的真谛。本文则认为立足于科学的实践观点,遵循实践思维的内在逻辑考察法和法律相对于实践主体所具有的独特效用和功能才是马克思法哲学价值论的真谛所在。

Mr. Gong Pi-xiang proposed that the essence of axiology of Marx's legal philosophy is that Max incisive elaboration for the value property of the law and a great reform in the field of legal philosophy in civilized social, from the view of relationship between individual and society,law and liberty,equality and rights. But the author believes that adhered to practical viewpoints,essence of axiology of Marx's legal philosophy,following the internal logic of thinking practical rules,is the specific effects and functions of law,relative to the practical subjects.
