法官有责任通过法官解释权的行使在司法能动与司法克制之间维持一种有益的平衡——"温和的司法能动"。之所以倡导"温和的司法能动",是因为这种能动在程度上是适度的,在发展进程上是循序渐进的,不但可以维护法律的稳定性和可预测性,而且可以有效满足现实社会的需要,实现法律供给和现实需求之间的平衡。

In the construction of a harmonious society and legal system, judicial activism and judicial restraint play different roles and the judges are responsible for maintaining a good balance between them by means of legal interpretation. The author applauds and advocates “moderate judicial activism”, because it’s moderate in degree and piecemeal in process of development. moderate judicial activism not only can maintain the stability and predictability of law, but also can effectively meet social needs, achieving a balance between the supply of justice and the actual demands.
