行政赔偿作为国家赔偿制度的一个重要方面,对于保护公民合法权益,促进行政机关依法行政发挥着十分重要的作用。但是由于受到行政赔偿范围的限制,仍有一些侵犯公民合法权益的行政行为得不到法律的制约,致使行政相对人在受到行政行为侵害时无法得到国家赔偿的救济。其中较为突出的是违法规范性文件的行政赔偿问题。由于规范性文件自身的性质及其在我国行政法中所处的特殊地位,使得解决这一问题变得尤为复杂。

Executive compensation is an important part of the national compensation system. It plays a very important role not only in the protection of citizens’ legitimate rights and interests,but also to promote administration organs act according to law .However, due to restrictions on the scope of executive compensation, there are still some violations of citizens’ legitimate rights and interests of administrative acts without legal constraints,and it makes that administrative relative person can not obtain the state compensation when they suffer damage form administrative organs.One of the most prominent problem is the compensation of illegal administrative normative documents. Because of the nature of normative documents and their special position in administrative law,it maks this problem become particularly complicated .
