人民法院参与社会管理创新初探——以民事审判为视角

Participation of the People's Court in Social Management Innovation——In the Perspective of Civil Trial

人民法院通过民商事审判、刑事审判、行政审判等审判活动来调整影响社会管理的行为。其中,民事审判与人民工作、生活息息相关,其公正公平的审判结果为和谐社会的建设提供法律保障。本文先对人民法院在社会管理创新的角色定位进行阐述,再从人民法院的民事审判如何推进社会管理创新着手,并从两个方面分析了民事审判推进社会管理创新的途径。

The people's court adjusts and influences social management behavior by civil and commercial trial, criminal justice, adminis-trative trial. Hereinto, civil trial is closely related to people's work and living, fair trial results provide legal guarantee for the construction of a harmonious society. This paper elaborates on the people's court in the role of social management innovation. Then, it analyzes how to improve the innovation of social management by civil trial. At last, it explores two aspects of civil trial to promote social management inno-vation.
