Reviews and Development Advices on China's Special Education Legislation

特殊教育是我国教育事业不可或缺的一部分。我国已初步建立起特殊教育法律体系框架,但是与发达国家相比,我国特殊教育立法尚需专业化和精细化。主要问题包括立法观念滞后、缺乏可操作性、立法刚性不强、法律责任相对缺失,需要通过加强立法研究、扩大特殊群体参与、借鉴发达国家立法经验等措施,切实加快我国特教立法进程发展。

Special Education is an important part of China’s education system. This essay reviewed the development of China’s special education. Compared with developed countries, China’s special education legislation needs to be professionalized and specialized. Its existing problems include out-of-date legislation concepts, lack of feasibility, not mighty enough and lack of legal liability. To speed up legislation process of China’s special education, more efforts should be made to strengthen legislation study, increase participations of special groups and learn from the developed countries.
