残疾人就业权保障立法研究

A Research on Legislation of Employment Right Protection for the Disabled

残疾人就业权保障是残疾人享有的各项权益保障中的重中之重,法律是保障残疾人就业权最有效、最基本的手段。本文以"权利与保障"为思考的立足点,用比较研究方法,通过比较其他国家残疾人就业权保障立法与我国相关立法,剖析我国现行残疾人就业权保障制度存在的不足,就完善我国残疾人就业权保障法律制度提供若干建议。

The protection of the disabled people’s right to employment is the most important one in their rights protection. This article was built on the thinking of rights and security. It compared some developed countries’ legislation of the disabled people’s right to employment protection with the relevant legislation of our country and analyzing the situation of this right realization and the insufficiency in the disabled people’s right to employment protection system of our country. Finally, it provided some suggestions to improve the legal system of the disabled people's right to employment protection.
