Influence and Exception of the Insurance Interest to the Validity of Marine Insurance Contract

保险利益是保险合同的效力要件,保险利益原则是保险法的基本原则之一。然而,保险利益原则在海上保险中有很强的特殊性,尤其是在保险利益存在的时机和保险利益的具体表现形式上和一般的财产保险具有很大的不同。本文论述了保险利益对于海上保险合同效力的影响及其例外,并提出完善《海商法》关于海上保险的建议。

'No insurance interest,no insurance law.' There exists the specialty in the principle of the insurance interest in the marine insurance law,especially in the aspects of its existence time and the specific forms,which are of big differences from the common property insurance.The paper illustrates the influence of the insurance interest to the validity of marine insurance contract,and the exception of the insurance interest in marine insurance,and presents some suggestions on the improvement of the marine insurance.
