论宪法审查的价值目标

On the Value Objects of Constitutional Review

宪法审查是保障宪法实现的有效机制。国内已有研究多着眼于对欧美审查模式的比较及中国模式的设计。事实上,对于任何一个法律制度,要真正确立并有效运作,首先应该明确其价值目标。文章从这一角度对宪法审查制度进行了探讨,指出宪法审查有人权保障和法制统合两种主要的价值目标,且这两种价值目标之间呈现交叉融合之势。

Constitutional review is an effective system to ensure the execution of the constitution. The researches in China focus mainly on the comparison between the American mode and the European mode, and the design of China's mode. First thing first, actually, is to have a definitive value object to any judicial system. The paper discusses the constitutional review based on this point of view, which indicates that there are two important value objects of constitutional review, the protection of human rights and the regularity of legal system and there is a tendency to make the two integrated with each other.
