摘要
目前,我国学者对商号权的研究多局限在商号权与商标权冲突的问题上,而对商号权之间的纠纷研究甚少,对商号制度缺乏深层次的剖析。事实上,商号概念的模糊、法律地位的不明确以及现行的企业名称登记制度等都是导致商号纠纷频繁的原因。因此有必要对现行商号制度背后的理论进行分析与反思,进而寻求解决纠纷的途径。同时,全国首部商号保护地方性法规《浙江省企业商号管理和保护规定》的出台也为商号的制度设计提供了实践的范本。
Now, many scholars in China have focused on the confliction between the rights of brand and trade names. But only a few have done any research on the troubles in the right of trade names. In fact, there exist many troubles, such as the fuzziness of the trade names, the inexplicit legal status of the trade names and the system of the trade name registration. So we should analysis and reconsider the existing system in this area and try to find the way of settlement. In addition, the first local laws and regulations of trade names recently issued by Zhejiang Province can offer us an exemplification.
