联合国残疾人权益保障的相关文件及评述

Review on UNESCO′s Documents about the Rights of the Disabled

联合国残疾人权益保障相关文件的主要内容体现在四个方面:(1)对残疾人身心功能发展的重视;(2)提升残疾人实现自身价值的机会成本;(3)强调残疾人的平等权利;(4)给予相关的社会支持与福利保障。这些国际性文件的主要特点是:具有约束性、指导性,但不具有法律效应;思想一脉相承,不断发展,但其实施有待完善;关注的范围更广泛、具体,但不够全面、深入;残疾人地位逐步得到提升,但依然相对被忽视。在"以人的发展"为最终发展目标的促使下,联合国在今后制定残疾人权益保障相关文件时也会有相应的变化与发展。

There are four main aspects of UNESCO′s documents about the rights guarantee of the disabled: (a) attaching importance to their physical and mental development;(b) raising their opportunity cost to make their self-value come true;(c) emphasizing their equal rights;(d)providing the relative social supports or welfare guarantee. The traits of these documents are as follows: they are inhabitable, directive, but not juristic; they develop continuously, but incompletely; they contain extensive views but non-deeply; they raise the disabilities′ status, but neglect it relatively. After the "human development" is recognized as the final developmental aim, UNESCO will develop and change correspondingly on presenting the documents about the disabilities′ rights guarantee in the future.
