在劳务派遣三方法律关系中,争议较多地集中在劳务派遣机构与用工企业之间的权利义务划分上。为了实现实施劳务派遣的预期目的,劳务派遣机构与用工企业应按照法律的规定以及各自的具体情况,合理、公平地设定劳务派遣服务协议中各项条款的内容。
In the three-party legal relationship in labor dispatching service,disputes mostly focus on classification of rights and obligations between labor dispatching institutions and employers.In order to achieve the implementation purpose of labor dispatching,labor dispatching institutions and employers are expected to enact the reasonable terms of labor dispatching service agreements in accordance with the relevant provisions of law and their respective specific situations.
