摘要
收容教育制度作为一种长期限制人身自由的行政强制措施,对打击卖淫嫖娼活动、维护社会治安秩序具有积极作用。但是,收容教育制度在权力实体设置运行及权力程序设置等方面存在诸多缺陷,影响了其合法性与合理性,应当对其重新进行合理设计。
Being a mandatory administrative measure restricting long-term personal freedom,detaining education system plays a positive role in cracking down on prostitution activities and maintaining the social security order.However,there are numerous defects in detaining education system in terms of power entity settings and operation,powers process settings,which affects legality and rationality of the system.Therefore,the article suggests that detaining education system should be properly redesigned.
