摘要
犯罪控制与人权保障的冲突在刑侦领域尤为凸显,刑侦部门对信息资源的高度依赖决定刑侦信息化在有效侦破案件的同时也会存在侵犯权利的风险。实现侦查程序的控制,并对侦查机关采集、使用个人信息过程进行规范,就可以达到保障公民信息权利乃至人权的终极目的。
Crime control clashes with human rights security,which is getting prominent in criminal investigation.The high reliance of investigation institutions in information society on information resources determines the effect of informationalized criminal detection in cracking a criminal case and the risk of violating individual rights.The implementation of detection program control and collection of investigation institutions can achieve the ultimate objective of guaranteeing citizen's right to get information or even human right.
