On Interests Construction in Marriage Law

婚姻利益包括婚姻当事人利益、家庭利益和社会公共利益。婚姻法作为婚姻家庭社会管理的主要工具,具有保护多重婚姻利益和实现婚姻家庭功能的目的。运用类型分析法,以婚姻法中的利益冲突类型为线索,通过剖析婚姻法的规范设置,梳理我国婚姻法利益配置特点,探究其利益配置规则。

Marriage interests involve the interests of the marriage parties,family interests and public interests.As an essential tool for managing marriage,families and society,marrige Law plays the roles of protecting marriage interests and implementing marriage and family.In the light of the conflict of interests and regulations setting in Marriage Law,the article uses category analysis method to sort out configuration features of interests allocation of China's Marriage Law and probe into the principle for marriage interests allocation.
