中国强制法规定了"排除妨碍,恢复原状"的法制方式,这是机动车违停拖移的法律依据。据此,交警可以对诸如阻拦拖车的当事人采取行政法制措施,但在实施时要对拖移行为进行合法性审查。
Compulsory laws of China provides for 'removing barriers for restoration to the original state',which is the legal basis for handling parking violation and dragging-and-moving of automobiles.Accordingly,the traffic police may take administrative legal actions on offenders who block dragging-and-moving of illegally parked automobiles.But legality reviews should be made on dragging-and-moving of illegally parked automobiles.
