当今中国法学教育反思——以法学高等教育为例

Reflections on legal education in Nowadays' China——Case of Legal Higher Education

改革开放以来,我国法学教育进行了大幅度改革,至今已取得了迅猛发展。但不可否认的是,我国法学教育仍然存在不少问题。本文考察了当代中国法学高等教育的现状,在回归法学高等教育发展的历史过程中,反思当下中国法学高等教育所面临的问题,主要包括:法学教育的数量和质量矛盾、法学高等教育的理念问题、法学教育与法律职业技能、法学教育的权利话语这几个方面的问题,并且思考其产生的原因,提出相应的意见,并指出解决当下法学高等教育所遇到的复杂问题的关键在于法学高等教育理念的修正。

Since reform,China has been a significant reform of legal higher education and has been achieved rapid development. But it is undeniable that China higher legal education still has many problems. This paper examines the status of legal higher education in contemporary Chinese and reflects on the problems happened in contemporary Chinese legal higher education which include the contradiction between quantity and quality of legal higher education,the idea of legal higher education,the relationship of legal higher education and legal professional skills,the right discourse of legal education. Thinking about the causes of these problems and giving corresponding views. On this basis,this paper puts forward some proposals for the future reform.
