侦查辨认人的主观心理研究

Research on Investigation of Witness's Subjective Psychology

辨认人作为辨认过程的主要参与者,其记忆、动机、表达能力等方面存在影响辨认的因素,且易受暗示的影响。侦查人员应当在理解辨认人心理机制的基础上,掌握好辨认时机,加强对辨认人的心理引导;改变辨认前的询问方式,发掘辨认人的辨认潜力;规范辨认组织者的语言及行为,避免产生暗示问题,实现辨认目的。

As the major participants in identification process,the witness's identification is affected in terms of memory,motivation and presentation skill,which are easily influenced by insinuation.On the basis of understanding the witness's psychological mechanism,the investigators should grasp identification opportunity and strengthen the witness's psychological guidance,improve the consultation modes before identification,excavate the witness's identification potentials,standardize the organizers' language and behaviors in an attempt to avoid some insinuations,standardize identification process and achieve identification purpose.
