“情况说明”的证据规范研究——兼论侦查人员出庭作证制度

Studies on Specifications of Evidence for“Facts Statements”——Concurrently about the System for Investigators Appearing in Court as a Witness

"情况说明"是侦查人员对在执行侦查权过程中了解到的情况向起诉、审判机关提供的书面说明材料。由于我国立法对"情况说明"没有明确规定,这一证据形式在司法实践中存在滥用之势并被赋予较高的证明力。因此应当区分情况,规范"情况说明"的适用范围,并在此基础上构建侦查人员出庭作证制度,以发挥其应有作用。

Facts statements'refers to the written documents submitted to judicial organs by investigators based on the information they get in execution of their investigation rights.Due to lack of explicit stipulations in China's legislation,the document of this form is abused and endowed with probative force.Therefore,we should standardized the applicability of 'facts statements'based on the actual situations and construct the system for investigators appearing in court as a witness so that it can really work.
