摘要
所谓跨境赌博是指中华人民共和国公民以赌资出境方式参与境外赌博的违法犯罪行为。从构成上讲,跨境赌博行为主体为中国公民,行为体现为参与赌博,行为具有违法犯罪性,其中赌资出境是必要条件。从特点上讲,跨境赌博以赌资出境为唯一方式,具有特殊的社会危害性,违法犯罪可追诉性较弱。从对策上讲,有效打击跨境赌博必须依法对其定性处罚,有效控制赌资出境,同时削减赌资来源,另外还要考虑博彩合法化问题。
Cross-border gambling represents c riminal acts on the part of Chinese citizens who take funds for overseas gambling.Structurally,the Chinese citizens constitute the behavioral subjects in cross-border gambling,whose illegal behavior is embodied in the participation in gambling.Characteristically,cross-border gambling,which is practiced solely by taking funds out of the border,has special hazard to the society,the illegal crime weak possibility can be procecated.Strategically,to effectively crack down cross-border gambling,we are expected to take up qualitative punishment for it according to law and effectively control over taking funds out of the border,meanwhile,cut down funds source and take into account lottery legalization as well.
