摘要
翻供作为一种客观现象,在刑事诉讼中普遍存在,其之所以存在是有多种原因的。办案人员应辩证理性地看待翻供对案件的影响,既要看到积极有利的一面,更要看到消极不利的方面。要正确审查判断证据,依法全面规范地讯问并将其固定,全方位收集其他证据,对犯罪嫌疑人、被告人进行法律政策教育和情感感化,把握诉讼的主动权,实现打击犯罪与保障人权的有机统一。
There are many reasons for confession withdrawing,which is a universal objective phenomenon in criminal proceedings.The case Investigators should dialectically and rationally think of the influence of confession withdrawing on the cases and get aware of both its positive effect and negative influence.Accordingly,efforts need to be made to examine and judge the evidence,make thorough and standard interrogations according to law,collect other evidences in a fixed and all-around way and educate the criminal suspects and defendants about the legal policy in an attempt to keep a firm grasp on the initiative in a lawsuit and organically unify crack-down on crimes and human rights protection
