宅基地退出:兼顾效率与公平的补偿标准

Rural Residential Land Exit: Balance between Efficiency and Equality of the Compensation Standard

研究目的:依据宅基地退出过程中宅基地价值的演变规律,为在现有宅基地产权制度下,合理确定兼顾效率与公平的宅基地退出补偿标准提供科学依据,促进宅基地的有效退出和保障农民的合法权益。研究方法:理论分析法,实证分析法。研究结果:在完全竞争市场和买卖双方要价能力相等的条件下,宅基地退出将会产生均衡的补偿价格(P2n1+P2N-n1)/2,农民获得退出宅基地的补偿价值(P2n1+P2N-n1)/2将会既有效率又兼顾公平。研究结论:兼顾公平与效率的宅基地退出补偿标准具有一定的可行性,并通过完善宅基地产权制度、建立城乡统一的土地市场和构建科学合理的宅基地评估机制促进该方法的使用和发展。

Objectives: On the basis of evolvement rule of homestead value during the homestead exit progress,this paper aims to reasonably supply a scientific basis of homestead exit compensation standard by taking both efficiency and fairness into account under the current homestead property system,as well as to promote the effective exit of homestead and protect the lawful rights and interests of farmers. Methodology: Theoretical analysis method; Empirical Analysis Method. Results: In the condition of perfect competition market and an equal charge capability of both buyers and sellers,the homestead exit would cause a balance compensatory price((P2n1+ P2N- n1)/2),the price((P2n1+ P2N- n1)/2) of which the farmers acquired would be not only efficient but also fair. Conclusions: It is feasible of homestead exit compensatory standard to a certain extent when concerning both efficient and fairness. Besides,the compensatory standard could be practiced and developed by perfecting the property system of homestead,establishing a land market which unify the urban and rural areas,as well as structuring a rational and scientific homestead assessment system.
