浅析数学建模相关专利申请的客体问题研究

Analysis for Subject Matter of Patent Application Relating to Mathematics Modeling

随着计算机和网络技术的发展,涉及数学建模的图像通信方法专利申请日渐增多。由于涉及建模方法和数学方法的申请本身在客体判断上就一直是审查工作中的一大重点和难点,当其与图像通信相结合而产生的专利申请的客体判断变得更加困难。笔者在审查过程中对遇到的几个案例进行分析,以期对相关的专利申请的撰写、修改提供参考与借鉴。

With the development of the computer technology and the network technology,patents relating to mathematics modeling are widely applied in the image communication field.The patent applications relating to mathematics modeling have been growing rapidly in recent years.In this paper,based on the analysis of typical applications relating to mathematics modeling,the provisions suitable for different applications have been emphasized and some suggestions of how to draft and amend claims that relate to mathematics modeling have been put forward.It is hoped to be helpful for the people having ordinary skill in the art.
