Suggestion about Writing Patent Application Based on Experience of Examination on Amendment Going Beyond Scope

在发明专利申请审批过程中,无论是申请人请求对申请文件作出的主动修改,还是应审查员在实质审查过程中提出的审查意见作出的被动修改,都要符合专利法第33条的规定。通过对专利法第33条的法条释义以及立法宗旨的介绍,并结合图像通信领域的实际案例,分析了申请人在对申请文件进行修改时会出现的几个问题,根据对上述案例的分析给出专利申请文件的撰写建议。
