浅谈专利法第22条第3款的判断标准——以具备复审案件为例

专利法第22条第3款是专利审查中涉及的主要法条之一。以两个撤销驳回决定的复审案件为例,分析了在审查过程中进行公知常识的认定,以及对比文件结合的标准。在加深对创造性理解的同时,也为申请人在撰写发明专利申请时,把握其技术方案是否具备创造性提供了一些参考。

Article 22.3 is one of the main articles in patent examination.In this paper,through two cases in which a request for reexamination is allowed,the standards for identifying the common knowledge and combining the reference documents are analyzed.The paper enhances the comprehension to the principle of inventive step,and provides applications a reference on how to achieve predictable result on inventive step judgment.
