我国游艇安全准入法律制度研究

On Chinese yacht safety access legal system

从我国游艇安全准入法律制度的现状看,主要是沿袭了营运船舶的水上交通安全监管法规。就海事实践而言,游艇安全准入法律制度中存在游艇的定义不明确、游艇登记管理制度滞后以及现行游艇检验制度可操性差等主要问题。完善我国游艇安全准入法律制度,要明确游艇的定义边界,调整现行的游艇检验制度,调整游艇的登记制度并建立完善我国游艇技术标准。

The current legal system of yacht safety access mainly follows the water transport safety regulations of the ships. In terms of maritime practice, the definition on yacht is not clear, the yacht registration management system is still lagging, and the present inspection system' s feasibility is poor. To perfect our safety access legal system, we must clearly define the boundary of yacht, adjust the yacht inspection system as well as the yacht registration system and establish the yacht technical standard.
