论体育法的社会法属性--基于黑格尔法哲学的体育法本质解读

Social Law Attributes in Sports Law——Interpretation of the Sports Law Essence Based on Elements of Philosophy of Right by Hegel

体育法本身就是存在的,并不是因为体育法典的产生而产生。体育法本质属性的解读是体育法研究的前提和基础,体育的社会性奠定了体育法的社会性基础。我们从社会法的调整对象和社会法的本位观、利益观和公平观来对社会法的特征进行定位,然后运用黑格尔法哲学的市民社会理论来论证体育法的社会法属性:体育法的本位观是保障体育权利;体育法的利益观是维护社会整体利益;体育法的价值观是实现公平。

Sports law doesn’ t come into being with the sports code because it does exist. The interpretation of the essential attributes of sports law constitutes the premise and foundation of the research of sports law. The sociality of sports lays the social foundation of Sports Law. After positioning the features of social law based on the adjustment ob-ject, standard concept, interest and fairness of social law, the paper uses the civil society theory in Hegel's philosophy to prove the social attributes of sports law.
