摘要
近年来,以各类资产收益权为标的的金融投资产品在市场中频频出现,但资产收益权本身的法律性质却至今在法学理论及立法实践中未见明确界定。本文从多个角度对资产收益权的物权属性进行了分析、论证,并结合实务经验对以资产收益权为标的的金融产品的相关风险提出了防范建议。
In recent years,financial investment products with the return rights on assets as the subject have appeared frequently,but the legal nature of the return rights on assets has not been defined in theory and practice. This paper analyzes and demonstrates the relative risk of these financial products and proposes some suggestions to prevent risks.
