摘要
新修正的《消费者权益保护法》虽增加规定了消费者无条件解约权,但其适用形态仅限于远程销售。参考国外有关立法和学理,应对消费者无条件解约权适用的交易形态予以适度扩张。消费者无条件解约权适用的传统交易形态通常仅限于动产,能否适用于房屋买卖等不动产交易,因其涉及购房者及销售者的重大利益,故应当有限制地予以适用。
The consumer unconditional cancellation right is added into the new amendment of Consumer Protection Law,but it is applicable only in the remote sales. According to foreign laws and theory,the consumer unconditional cancellation right should be enlarged properly,namely,whether it should be applicable in the sale of housing. Of course,it is closely related with the buyers and sellers of housing,so its usage is limited in some degree.
