Definition of “Public Interest”of House Levying Compensation in the Process of Urbanization

本文就如何科学合理地界定"公共利益"进行研究,提出符合"公共利益"需要是国家征收搬迁公民私有房屋的前提和条件。"公共利益"就其内涵而言,是不特定多数人的利益,特定的、部分人的利益一般不属于公共利益的范畴。征收是否符合公共利益可从以下几方面去判断:征收后的用途为公众所需;征收后的新建设施是否为公共所用;征收行为是否符合法定程序和要求,这三个基本要素构成一个整体判断标准。

This paper studies on how to define 'public interest'scientifically and reasonably. We put forward that in line with the 'public interest'need is the precondition of imposing citizens' private houses and relocating citizens mandatory. In terms of its connotation,'public interest'is a non-specific interests of the majority of people. A particular part,the interests of the people generally do not belong to the category of public interest. There are three aspects to judge whether levy is in accordance with the public interest:(1)collection of USES for the public requirement,(2)new facilities for public use,(3)levy behavior is in accordance with the legal procedures and requirements, this three basic elements constitute an overall judgment standard.
