检察官客观义务与司法伦理建设

Objective Obligation of Prosecutor and Judicial Ethics Construction

检察官客观义务是检察伦理的核心内容。实践中,检察伦理的缺失不仅会导致冤假错案和个案处理不公,而且会导致司法公信力的缺失,也无法形成良好的法治环境,对国家依法治国方略的实施形成很大障碍。检察机关应当秉持客观义务,从客观义务伦理的内在要求和现实状况来建设检察机关伦理道德,并重点关注正义精神、公平意识、公益之心、法治信仰和诚信伦理。同时,还要认真研究检察官伦理建设的有效性问题,即尊重现实人性,固守"底线伦理";发挥示范作用,形成"引导伦理";重在制度建设,生成"规制伦理";协调矛盾冲突,确立"至上伦理"。

Objective obligation is the core element of procuratorial ethics. The absent of procuratorial ethics will cause wrong and false cases and injustice in individual case,deprivation of judicial authority,and difficulties in forming good legal environment,which constitutes obstacle to rule of law in China. Procuratorates should insist performing the objective obligation,carry out ethics construction according to the inherent requirement of the objective obligation and current situation,emphasizing justice,impartial,legal faith and honesty. At the same time,the effectiveness of ethics construction should be studied seriously,that is to respect humanity and adhere to bottom ethic,play an exemplary role and form guiding ethic,focus on institutional improvement and generate regulatory ethic,harmonize the conflicts and establish supreme ethic.
