异地高考权就是异地高考考生要求在当地参加高考并按当地标准录取的权利,它来源于宪法上的教育平等权。教育平等权作为基本权利,要求政府履行促进教育均衡发展、取消省籍报考资格许可、提供统一的能力测评标准的义务。高校招生自主权来源于宪法上的学术自由,学术自由要求赋予高校招生自主权,抛弃以省籍分配招生指标的办法,形成与各高校专业特色相适应的多元化的自主招生形式。

The right of immigration college entrance examination is the right of immigrants taking college entrance examination where they live now and being enrolled by the local standard,which stems from right of education equality according to the constitution.As a basic right,right of education equality calls for government to promote balanced education development,abolish provincial examination qualification license and provide the examinee ability standard.Enrolment autonomy of colleges and universities is from academic freedom in the constitution,which gave colleges and universities the right to enroll autonomously,and abandon provincial distribution of enrollment,forming a diversified independent recruitment pattern compatible with the specialty characteristics.
