价值导向方法在我国司法实践中的运用探究

价值导向方法是以价值为导向的方法,而司法中的价值导向方法,指的是将作为导向性的价值标准明确为反映在制定法和制定法所蕴含的价值观念,并运用价值思维进行司法活动的一种方法。自从拉伦茨提出关于价值导向的思考方法以来,对价值导向方法尚无充分系统的理论阐述,在我国的司法实践活动中,由于对价值导向方法认识上的不足,法官在司法活动中不能运用价值思维正确地思考法律规范中的价值判断。司法中的价值导向方法坚持以制定法和制定法所蕴含的价值为导向,要求法官在司法活动中运用价值思维认定案件事实、选择和解释适用的法律规范。只有这样,才能够使法官对具体案件的各种判断符合司法认知的规律。

The value orientation method means that we should reflect the guidance value standards in theenacted law, and use value thinking to run judicial activities. Legal norms are one of the idea systemswhich social evaluation based on. The value orientation method is the necessary method in the judicialacts. But the current legal theory of value orientation method, which was first proposed by Karl Larenz,haven't elaborated as a systematic theory. In the judicial practice in our country, judges can't use thevalue thinking mode correctly to think about the value judgement in legal norms, because they haven't un-derstood the value orientation method sufficiently. In legal methodology theory, there are two tasks to besolved, one is finding the specific value standards, the other one is making reasonable referees when thelegal system is not perfect. Judges need to use value thinking to find the facts, to choose and explainthe correct legal. Only in this way, can make the judgment comply with the principle of judicial notice.
