Our country is facing a serious problem with the aging of the population,by the continuous promoting of social transformation and new urbanization,new structural social community is forming,aging population becoming more grim,moreover,the proportion of empty nesters become more and more heavy in the aging group,the protection for empty nesters is a serious problem from now to tomorrow. It's a natural rule to respect,care for,support and help the elderly,which is the traditional virtue of our Chinese nation,however,in the impact of the wave of industrialization,the living of empty nesters lack of routine care and spiritual solace,which reflects the crisis of piety and the inability of modern law. Dealing with the serious challenge of protecting the interest of empty nesters in the era of filial crisis,exploring how to improve the protection of them from a legal perspective,which has important value both in theoretical side and in practical side.
