论行政处罚中单位证明的证据效力

On effect of unit proof of evidence in administrative punishment

单位证明在行政处罚中经常被作为证据使用,但是其效力如何,就存在较大争议。本文认为对单位证明的证据效力不能够一概而论,应该分形成于事前的单位证明和形成于事后的单位证明两种不同的情况分别对待。

The unit proof in administrative punishment is often used as evidence, but the effect is still controversial. This paper considers the effect of evidence of units that can not lump together, should be formed in the pre unit proof and formed in the later units proved two different situations respectively.
