摘要
劳务派遣作为一种新机制,各方面体系和规范还不完善,存在诸多问题。规范和完善劳务派遣制度应从多方面着手,应当明确责任、规范劳资三方的行为,从法律制度层面对劳务派遣进行指导和制度调整。用工单位和派遣机构也应该完善自身企业管理机制,建立明确的解决劳务纠纷的机制,将劳动者的利益落实在实处,切实维护被派遣劳动者的合法权利。
The labor dispatch as a new mechanism, the system and the standard is not perfect, there are many problems. Standardizing and improving the labor dispatch system from many aspects, should be clear responsibilities, standardized labor three party behavior, guidance and regulation of labor dispatch from the level of legal system. Labor units and the dispatch agencies should improve its management mechanism, mechanism is established to solve the labor disputes clear, will put the interests of workers in practice, and earnestly safeguard the legitimate rights of dispatched workers.
