在学生状告母校的案件层出不穷的今天,高校教师惩戒则出现另一种趋势,教师惩戒权的行使正在弱化,这严重影响到了高校教育目标的实现。本文探讨了教师惩戒权的弱化及其成因,并指出教师惩戒在高校教育中存在的必要性和正当性,进而指出应构建科学的教育惩戒机制,加强教师惩戒权的行使,以保障高校教育教学质量。

In today of the students sued the school cases emerge in an endless stream, university teachers' disciplinary is another trend, teachers' right of punishment is weakening, which seriously affects the realization of the goal of university. This paper discusses the weakening and the causes of the punishment power of teachers, and the necessity and legitimacy of teachers disciplinary exists in higher education, and then points out that we should construct the disciplinary mechanism of scientific education, strengthen teachers' right of punishment, in order to guarantee the teaching quality of higher education.
