摘要
美国《统一代理权法》是当前对持续性代理权制度加以规定的一部非常成熟的法,从尊重委托人意思,明确代理人权利义务,保障第三人承认等方面发展和完善了新内容,解决了之前州法分歧及代理权滥用的问题。做为替代决定机制,相比法定监护,它活用了成年障碍者残余的意思能力,满足了其生活正常化的需求。我国新出台的《老年人权益保障法》第26条已经初见类似制度的端倪,因此,该法对完善我国意定监护制度有着重大的启示意义。

Assubstitute decision mechanism, compared with the legal custody, it use the adultdisability residual mean ability, to meet the normal demand. China's new 'senior citizen rights and interests protection law' twenty-sixth article has produced similar system gradually, therefore, the method to improve our guardianship system is of great significance.
