现代大学治理的法权边界

法权是法定之权,包括权力和权利。高等教育领域中权力和权利的分配应该由法律来完成,并通过契约章程进行分权与问责。明确大学的法律地位是现代大学治理的前提,大学各类法权边界的确定是法律规制的起点。现代大学要实现良法善治,就要明确大学与政府、市场等外部法权主体之间的法权边界,也要明确大学与学院、学术与行政、党委与校长,学校与师生等内部法权主体之间的法权边界,并在此基础上进行合理的法权分工和定位。
