摘要 农地承包权与经营权分置将使产权结构更加精细化,但是学术界对于能否以及如何分置、分置后的权利关系、权利性质和地位等基本内容存在根本分歧。根据归属与利用的物权状态二元结构原理可以清晰界定分置的产权结构:归属状态的承包权与利用状态的经营权分置,均属独立的、内生的物权状态,分别具有不同的物权特性。归属状态的承包权,属人与物的法律关系,主体可排他性分置和流转经营权,政府职能是明确和保护产权;利用状态的经营权,属主动性物权和有害性物权,因此既要放活又要限制,缘自私权利的市场限制与公众利益的政府限制双向结合。 The division of agriculture land contract rights and management rights is more refined ,but there are opinion differences about whether and how to split it in the academic community .The rights can be clearly defined based on the dual structure of use rights .The division of sub‐contract rights and the divi‐sion of management rights are independent and endogenous ,and they have different characteristics .Con‐tract in belonging state is a legal relationship between persons and things ,in which the body may split and transfer exclusive right to operate and the government mainly recognises and protects the property rights ;franchise use state property belongs to the initiative and hazardous property ,which needs both deregula‐tion and restriction .Restrictions on the market from private interest and the government restrictions from the public interest combined .
