《婚姻法》中家务劳动补偿制度的立法完善

Towards Perfecting the Legislature on the Compensation System for Housework in the Marriage Law of the PRC

我国《婚姻法》对于家务劳动补偿的性质和地位都没有专门的规定,也缺少具体、明确的相关规定,这不符合男女平等原则也不利于对弱势群体的保护,通过借鉴其他国家的立法规定,笔者对完善我国《婚姻法》家务劳动补偿制度给出了具体的建议。

The Marriage Law of the PRC does not have any specific rule on the nature and status of compensation for housework, nor are there any regulations concerning this question. This situation is not in consistence with the principle of equality between men and women, nor is it beneficial to the protection of the weak class. Through drawing on the legislature concern from other countries, the author put forward some suggestions for perfecting the legislature on the compensation system for housework in the Marriage Law of the PRC.
