An Economic View of Ancient China’s Criminal Law Principles

本文运用现在法学界发展比较快的经济分析法学,对中国古代刑法原则进行经济角度的研究,为改变大多数对中国古代刑法原则中国历朝社会发展史的研究或对思想演变层面狭窄的研究者都起着提示性的作用。

Much research has been done on ancient China’s criminal law principles from the perspective of social development and ideological changes, which is apparently rather narrow. This paper tries to make an analysis of the principles from an economic view which has witnessed a fast development in history.
