再论证据的信息本质

On the Nature of Evidence

我国证据制度的建立已经面临理论瓶颈,其根本原因在于没有科学解决证据的本质及其运动规律问题。本文认为证据问题首先是个科学问题,对证据本质的认识必须跳出法学领域,并认为证据的本质是信息。

The legislation of evidence-law in our country is facing a theoretical bottleneck situation,which can be attributed to the partial cognition on the nature of evidence and its rules for movement.The author believes that evidential issue is firstly a scientific one.To find the essence of evidence,we must look out of the field of law.When we do,we will find that the essence of evidence is information.
