浅议公证程序中的释明——对《公证法》第二十七条的解读

A brief account of explanation right in notary process—an analysis of Article 27 in Notary Law

针对《公证法》中第27条,确认了公证人的释明权和公证程序中的释明之规定。分析并提出《公证法》中关于释明的规定较为简略,公证中的释明在实践中和理论界尚未得到应有的重视。为完善对公证程序中释明的认识和有益于完善公证人释明权的相关理论以及有利于案件公正处理有着推进作用。

Article 27 in Notary Law stipulates that notaries have explanation right.But the article is rather brief and does not receive much attention in practice.So it is necessary to make an analysis of the explanation right in Notary Law and draw people’s attention to it.
